This Helper Agreement ("Agreement") governs participation as a Helper on the 2Hands Platform. It is between you ("Helper," "you," or "your") and FitaSol LLC, doing business as 2Hands App ("2Hands," "we," "us," or "our"). This Agreement supplements the 2Hands Terms of Service and Privacy Policy.
By applying to become a Helper, affirmatively accepting this Agreement, or accepting or performing requests through the Platform after approval, you agree to this Agreement. If you do not agree, you may not participate as a Helper.
1. 2Hands Is a Technology Platform
2Hands operates a technology marketplace connecting Customers who request assistance with independent Helpers who may choose to perform those tasks. 2Hands does not itself perform the underlying Helper services. 2Hands may provide technology and administrative tools for displaying requests, matching, communications, scheduling, pricing, status updates, payments, payouts, location functionality, ratings, notifications, identity or eligibility review, support, fraud prevention, and Platform administration.
2. Helper Relationship
The parties intend that, to the extent consistent with applicable law and the actual relationship, Helper performs accepted services as an independent service provider and not as an employee of 2Hands. Nothing creates a partnership, joint venture, franchise, agency, or fiduciary relationship. Helper has no authority to bind 2Hands or FitaSol LLC. Nothing overrides worker classification required by applicable law.
3. No Guarantee of Work
2Hands does not guarantee any minimum number of requests, hours, earnings, continuous availability of opportunities, particular service territory, or that any Customer will select or proceed with a Helper. Availability may vary by demand, location, service category, Platform conditions, eligibility, and other factors.
4. No Required Schedule
Except for requests Helper voluntarily accepts, 2Hands does not require Helper to maintain a fixed work schedule. Helper may decide whether and when to make themselves available, subject to Platform functionality and applicable rules. Helper may stop making themselves available at any time, subject to obligations relating to requests already accepted.
5. Voluntary Acceptance of Requests
Helper is not required to accept every request. Helper may review available information and decide whether to accept an opportunity. Declining an available request alone does not create an obligation to perform it. Once Helper voluntarily accepts and is confirmed, Helper is expected to honor the commitment or cancel promptly when necessary.
6. No Exclusivity
2Hands does not require Helper to work exclusively through 2Hands. Subject to confidentiality, non-circumvention, and other obligations, Helper may provide services independently, use other platforms, operate another business, work for other persons or companies, or pursue other employment or business opportunities.
7. Helper Controls Performance
Subject to the Customer's agreed scope, applicable law, required licenses, safety requirements, Platform conduct rules, and legitimate Customer instructions concerning the desired result, Helper is responsible for determining the practical manner and means of performing the accepted task. 2Hands does not continuously supervise Helper's physical performance.
8. Platform Standards Do Not Create Employment
2Hands may establish standards relating to safety, professional conduct, eligibility, Customer privacy, request categories, communications, payment procedures, fraud prevention, prohibited services, ratings, and Platform quality. These standards are intended to protect Users and operate the marketplace and do not, by themselves, create an employment relationship.
9. Helper Eligibility
To participate, you must be at least 18, legally capable of contracting, provide accurate information, maintain an approved Helper account, possess the physical and legal ability to perform any request you accept, and satisfy additional requirements applicable to the request. 2Hands may approve or reject applications according to Platform policies and law.
10. Accurate Information
Helper represents that information provided to 2Hands is accurate and not materially misleading. Helper must maintain current name, phone number, email, payment information, tax information, service capabilities, and other information required for Platform participation.
11. Identity Verification
2Hands may require identity, account, document, or other verification, internally or through third-party providers. Approval or successful verification does not constitute a guarantee by 2Hands to Customers regarding future conduct, skill, reliability, licensing, or safety.
12. Background or Other Screening
If 2Hands offers or requires background screening, credential verification, or similar checks, Helper authorizes the applicable process as separately disclosed. No screening process guarantees that all available information is complete, current, or predictive of future conduct.
13. Skills and Competence
Helper may only accept tasks that Helper reasonably believes they can perform safely and competently. Helper is responsible for evaluating the task, physical requirements, tools, equipment, experience, environment, and other circumstances. Helper must not misrepresent skills or experience.
14. Licenses and Permits
Helper may not perform work requiring a professional, occupational, trade, contractor, or other government-issued license unless Helper possesses the license required by law or is otherwise lawfully authorized. 2Hands' display of a request does not determine that work may legally be performed without a license. Helper remains responsible for confirming requirements.
15. Insurance
Unless 2Hands expressly provides otherwise in writing, Helper is responsible for evaluating and maintaining insurance reasonably or legally appropriate for Helper's activities, potentially including automobile, general liability, professional, workers' compensation, occupational accident, or other coverage. 2Hands does not guarantee coverage under a 2Hands insurance policy merely because Helper uses the Platform.
16. Workers' Compensation
Nothing in this Agreement waives rights or obligations arising under applicable workers' compensation law. Where Helper is legally an independent contractor and not otherwise covered by 2Hands, Helper is responsible for determining appropriate or required coverage. If law determines that Helper is entitled to employment-related protections, this Agreement does not eliminate non-waivable rights.
17. Taxes
Helper is responsible for understanding and satisfying tax obligations arising from earnings received through the Platform to the extent Helper is treated as an independent service provider. 2Hands generally does not withhold payroll taxes from independent contractor payouts unless legally required. Helper may be responsible for federal, state, local, estimated, and self-employment taxes and business expenses. 2Hands does not provide individual tax advice.
18. Tax Documentation
Helper must provide tax documentation reasonably required by 2Hands or payment providers, including Form W-9 or successor documentation where applicable. 2Hands or providers may issue Form 1099 or other reporting documents when legally required. Failure to provide required information may result in backup withholding where required, payout delays, account restrictions, or inability to continue accepting requests.
19. Payment Providers
2Hands may use third-party payment providers, including Stripe, to facilitate Customer payments and Helper payouts. Helper may be required to establish or maintain a provider account and provide information requested by that provider. Payment providers may impose their own terms, verification requirements, restrictions, or processing schedules.
20. Helper Earnings
The amount payable to Helper for a request will be determined according to pricing or payout information applicable to that request. Before accepting, Helper may be shown hourly rate, fixed payout, estimated duration, additional Helper compensation, cancellation compensation, or other relevant payment information. Helper should review available payout information before accepting.
21. No Guaranteed Earnings
Estimated earnings are not guarantees. Actual earnings may depend on actual authorized time, completion status, approved modifications, cancellation rules, payment disputes, refunds, adjustments, tips, and other transaction-specific circumstances.
22. Platform Fees
2Hands may charge or retain Platform fees as disclosed through the Platform or applicable pricing structure. Helper acknowledges that the Customer's total charge may differ from the amount payable to Helper because Customer charges may include Platform fees, payment processing, taxes, additional services, or other amounts.
23. Payout Timing
Payout availability may depend on request completion, Customer payment, payment processor settlement, fraud review, disputes, chargebacks, verification, and other legitimate payment-processing requirements. 2Hands does not guarantee immediate access to funds after every request.
24. Payment Adjustments
2Hands may make reasonable payment adjustments when supported by transaction records, including for incorrect time records, duplicate payments, Customer-approved additional time, cancellations, refunds, fraud, technical errors, payment reversals, or other legitimate corrections. 2Hands will not intentionally withhold earned Helper payments arbitrarily.
25. Tips
Where tipping is supported, voluntary tips designated for a Helper will generally be payable to that Helper, subject to payment-processing limitations, fraud review, reversals, or applicable law.
26. Customer Cancellations
If a Customer cancels an accepted request, Helper compensation, if any, will be determined according to the applicable Cancellation & Refund Policy, Helper status, whether travel had begun, whether Helper arrived, whether work started, and transaction rules. A Customer cancellation fee does not necessarily mean the full fee is payable to Helper.
27. Helper Cancellations
Helpers should not accept requests they do not reasonably intend to perform. If Helper must cancel, Helper should do so promptly through the Platform. Repeated late cancellations, no-shows, or abandonment may affect eligibility or account status. Legitimate emergencies and circumstances outside Helper's reasonable control may be considered.
28. No-Shows
A Helper who fails to arrive for a confirmed request without properly cancelling may be considered a no-show. Repeated or serious no-shows may result in reduced Platform access, temporary restriction, review, suspension, or deactivation.
29. Arrival and Status Information
Helper may be required to update Platform status during an active request, including accepted, on the way, arrived, started, completed, or similar operational statuses. Helper must not intentionally falsify status information.
30. Location Information
Where enabled and disclosed, location information may be used during relevant Platform activity to determine proximity, coordinate arrival, verify service status, calculate distance, support safety, prevent fraud, or resolve disputes. Helper must not manipulate location information or falsely represent arrival, travel, or service activity.
31. Timekeeping
For time-based services, Helper must accurately record work time using available Platform functionality. Helper must not start time before legitimately beginning, continue time after work stops, fabricate time, coordinate false time with a Customer, or intentionally inflate service duration. Preparation or waiting time is compensable only where provided by transaction or Platform rules.
32. Scope of Work
Helper should perform only work reasonably within the confirmed request and Customer-approved modifications. Helper must not pressure a Customer to add unnecessary work. Material scope changes should be documented through the Platform where available.
33. Unsafe or Materially Different Requests
Helper has the right and responsibility to refuse or stop a request if conditions are materially different from what was disclosed or reasonably unsafe. Examples include hazardous materials, violent or threatening persons, dangerous animals, structural hazards, illegal activity, extreme physical requirements, unavailable equipment, or work requiring a license Helper does not possess. Helper should notify 2Hands when reasonably possible.
34. Emergencies
2Hands is not an emergency service. If Helper encounters immediate danger or a medical, fire, police, or other emergency, Helper should prioritize personal safety and contact appropriate emergency services when necessary.
35. Customer Property
Helper must treat Customer property with reasonable care. Helper may not intentionally damage, remove, take, use, dispose of, sell, or retain Customer property without authorization. Helper must promptly report significant accidental property damage.
36. Theft
Theft, attempted theft, unauthorized possession of Customer property, or fraudulent acquisition of property is strictly prohibited. Credible allegations may result in immediate account restriction while reviewed. 2Hands may preserve relevant records or cooperate with authorities where lawful and appropriate.
37. Personal Injury and Property Damage
Helper is responsible for Helper's own conduct and may be legally responsible for property damage, bodily injury, or other loss caused by Helper's negligence, misconduct, unlawful activity, or other legally actionable conduct. Helper should promptly report serious incidents. 2Hands' assistance does not transfer Helper's legal responsibility to 2Hands.
38. No Guarantee or Insurance by 2Hands
2Hands is not an insurer of Helper. Unless a separate written protection program expressly states otherwise, 2Hands does not guarantee payment for Helper injuries, medical expenses, lost earnings, property damage, vehicle damage, tools, personal property, or other losses incurred while performing a request.
39. Helper Equipment
Unless a request or Platform rule expressly provides otherwise, Helper is responsible for ordinary personal equipment or tools Helper chooses or is required to use. Helper must use equipment safely and lawfully. Customer-owned equipment should only be used with authorization and when Helper reasonably believes it can be used safely.
40. Vehicles and Driving
If Helper uses a vehicle in connection with a request, Helper is responsible for a valid driver's license when required, registration, legally required insurance, safe driving, vehicle condition, traffic laws, parking rules, and related obligations. Unless separately authorized, Helper may not represent that 2Hands provides commercial transportation services.
41. Transportation Restrictions
Helper must comply with Platform restrictions concerning transportation of Customers, minors, vehicles, materials, hazardous items, or other restricted activities. A Customer request does not override Platform restrictions or applicable law.
42. Children and Vulnerable Persons
2Hands does not authorize Helpers to independently provide prohibited babysitting or childcare services. Helper must comply with restrictions concerning minors or vulnerable persons and immediately stop participation in any request that appears to involve prohibited or unsafe activity involving a minor.
43. Animals
If a request involves animals, Helper should accept only if comfortable and capable. Helper may decline or stop if an animal presents an unexpected safety risk. Helper must not abuse or intentionally harm an animal.
44. Professional Conduct
Helpers must act professionally and respectfully. Threats, harassment, violence, sexual misconduct, discrimination prohibited by law, intimidation, fraud, theft, retaliation, coercion, or abusive behavior are prohibited.
45. Sexual or Romantic Conduct
Helpers may not use a service request as an opportunity to engage in unwanted sexual, romantic, or sexually suggestive conduct toward a Customer or other person encountered through the request. Sexual services are prohibited.
46. Drugs and Alcohol
Helper must not perform requests while impaired by alcohol, illegal drugs, or other substances in a manner that creates a safety risk or materially impairs performance. Helper may not possess, distribute, or use illegal controlled substances in connection with a request.
47. Weapons
Helper may not use or display a weapon in connection with a request in a threatening, unlawful, or inappropriate manner. 2Hands may prohibit weapons in connection with Platform activity regardless of whether possession would otherwise be lawful.
48. Customer Information
Helper may receive personal information concerning Customers only as necessary to perform Platform transactions, including name, address, communication information, request details, location, photos, access information, or other transaction-related data. Helper must use Customer information only for legitimate purposes connected with the request.
49. Confidentiality
Helper must not improperly disclose confidential or sensitive information learned through a request, including home access information, door codes, security details, Customer contact information, private documents, financial information, medical information encountered incidentally, personal communications, or other information a reasonable person would understand to be private.
50. No Marketing Using Customer Information
Helper may not use Customer information obtained through 2Hands for unrelated marketing, sales, mass messaging, lead generation, data resale, or solicitation without lawful authorization.
51. Photos and Recordings
Helper may take or submit photos when reasonably necessary to document work, confirm completion, document damage, support a dispute, or fulfill a Platform requirement. Helper must not photograph or record private areas or persons unnecessarily and must comply with applicable audio/video recording laws.
52. Social Media
Helper may not publish Customer-identifying information, private property details, request communications, or private photos on social media without lawful authorization. Helper must not imply that a Customer endorses Helper or 2Hands without permission.
53. Circumvention
Helper may not intentionally use the Platform primarily to acquire Customers and then move the same Platform-originated transaction off 2Hands for the purpose of avoiding applicable fees or rules. Repeated intentional circumvention may result in restriction or deactivation. This restriction does not create an employment relationship or prohibit unrelated independently developed business relationships.
54. Soliciting Customers
Helper must not pressure Customers to cancel an active or pending 2Hands request and pay Helper directly to evade the Platform. 2Hands may establish reasonable rules concerning Platform-originated relationships to prevent fee avoidance and fraud.
55. Customer Payments
Helper should not request direct payment from a Customer for amounts required to be processed through 2Hands. Helper may accept only payment methods or additional amounts authorized by applicable Platform rules.
56. No Unauthorized Charges
Helper may not demand or represent that a Customer owes additional money unless the amount is authorized, the work is approved, or the amount is legitimately due under Platform rules. Helper must not threaten, intimidate, or withhold Customer property to obtain payment.
57. Ratings and Feedback
Customers may rate or review Helpers. 2Hands may consider ratings, complaints, cancellations, reliability, safety issues, and other legitimate Platform information when administering Helper eligibility. No single rating necessarily determines account status.
58. Quality Concerns
2Hands may review complaints concerning service quality or Helper conduct. Helper may be asked to provide messages, photos, descriptions, receipts, or other evidence. Participation in a review does not make 2Hands the provider or supervisor of the underlying service.
59. Cooperation With Investigations
Helper agrees to reasonably cooperate with legitimate investigations concerning safety incidents, fraud, payment disputes, property damage, theft allegations, customer complaints, or violations of Platform policies. Helper is not required to waive legal rights or admit fault as a condition of cooperation.
60. Fraud
Helper must not engage in fake requests, fake accounts, self-dealing, collusive payments, fabricated hours, false arrival information, false claims, stolen payment methods, manipulated referrals, or other fraudulent activity. Fraud may result in immediate suspension or termination and referral to authorities.
61. Suspension
2Hands may temporarily restrict a Helper account while reviewing serious concerns such as safety, fraud, theft, violence, identity issues, payment abuse, customer harm, or material violations. Temporary restriction during a legitimate investigation does not guarantee eventual termination.
62. Deactivation
2Hands may deactivate Helper access for material or repeated violations including fraud, unsafe conduct, theft, violence, harassment, serious misrepresentation, prohibited services, repeated serious no-shows, payment abuse, circumvention, or other material violations. 2Hands may also stop offering Helper functionality or particular service categories.
63. Administrative Review
Where appropriate, 2Hands may allow a Helper to request review of a suspension or deactivation decision. Serious safety, fraud, legal, or security concerns may require immediate restrictions before review. Nothing creates rights beyond those required by law or expressly offered by Platform policy.
64. Ending Helper Participation
Helper may stop accepting new opportunities at any time. Helper should complete or properly cancel previously accepted requests. Ending participation does not erase obligations involving completed services, payments, taxes, fraud, Customer property, confidentiality, disputes, or other matters arising before termination.
65. Records After Termination
2Hands may retain records after Helper participation ends when reasonably necessary for payments, tax reporting, fraud prevention, safety, legal compliance, dispute resolution, account restriction enforcement, or establishment, exercise, or defense of legal claims. Retention is further described in the Privacy Policy.
66. Intellectual Property
Helper receives no ownership interest in the 2Hands Platform, brand, software, trademarks, design, or proprietary technology. Helper may use branding only as authorized and may not represent themselves as an owner, employee, office, branch, or authorized representative of 2Hands.
67. No Authority to Speak for 2Hands
Helper may not make public statements on behalf of 2Hands unless specifically authorized. Helper may describe themselves accurately as a Helper using the Platform but should not claim employment or agency status unless legally established.
68. Third-Party Services
Helper may use third-party systems through 2Hands, including providers for authentication, payments, maps, SMS, email, identity verification, or other technology. Those services may have separate terms and privacy notices.
69. Platform Availability
2Hands does not guarantee uninterrupted access to Helper opportunities or Platform functionality. Technical errors, maintenance, demand conditions, safety restrictions, account review, or third-party outages may temporarily affect access.
70. Helper's Own Business Expenses
Except where a request or Platform rule expressly provides otherwise, Helper is responsible for personal business expenses incurred while operating independently, potentially including phone service, internet, vehicle expenses, fuel, tools, equipment, insurance, taxes, and other costs.
71. No Benefits Promise
To the extent Helper is properly classified as an independent service provider under applicable law, Helper is not entitled solely by virtue of this Agreement to employee benefits from 2Hands such as paid vacation, paid sick leave, retirement benefits, health insurance, unemployment benefits, or other employee benefit programs. Nothing eliminates protections required by law.
72. No Authority to Hire on Behalf of 2Hands
Helper may not hire employees, subcontractors, assistants, substitutes, or additional persons to perform a request under Helper's account unless expressly permitted through the Platform. If additional Helpers are needed, they should normally be assigned or confirmed through 2Hands so persons entering a service location have appropriate authorization.
73. Account Is Personal
Helper's account is personal to Helper. Helper may not lend the account, share login codes, allow another person to accept requests under Helper's identity, or send an unauthorized substitute to perform a request.
74. Indemnification
To the fullest extent permitted by law, Helper agrees to defend, indemnify, and hold harmless FitaSol LLC, 2Hands, and their members, managers, officers, employees, affiliates, agents, and representatives from third-party claims, demands, losses, damages, liabilities, judgments, penalties, and reasonable legal expenses arising out of Helper's acts or omissions, services performed, negligence or misconduct, property damage or bodily injury caused by Helper, theft or fraud, violation of law or this Agreement, violation of another person's rights, unauthorized use of Customer information, or taxes, licenses, permits, insurance, or obligations for which Helper is legally responsible. This does not shift liability where law prohibits it.
75. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, 2HANDS AND FITASOL LLC SHALL NOT BE LIABLE TO HELPER FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO HELPER'S USE OF THE PLATFORM. TO THE FULLEST EXTENT PERMITTED BY LAW, 2HANDS IS NOT RESPONSIBLE FOR LOSSES CAUSED BY CUSTOMER CONDUCT, CUSTOMER PROPERTY, UNSAFE CONDITIONS CONCEALED BY A CUSTOMER, THEFT BY ANOTHER USER, CANCELLED REQUESTS, LOST BUSINESS OPPORTUNITIES, DAMAGE TO HELPER'S PERSONAL EQUIPMENT, OR OTHER USERS' INDEPENDENT ACTIONS. AGGREGATE LIABILITY TO HELPER ARISING OUT OF A SPECIFIC MATTER SHALL NOT EXCEED THE GREATER OF PLATFORM FEES RETAINED BY 2HANDS IN CONNECTION WITH THAT MATTER OR $100, EXCEPT WHERE LAW DOES NOT PERMIT THE LIMIT.
76. No Warranty Regarding Customers
2Hands does not guarantee that a Customer is safe, honest, owns the property, has accurately described the task, will behave appropriately, will not cancel, or will satisfy every obligation. Helper must use reasonable personal judgment.
77. No Insurance or Safety Guarantee
Account screening, Customer verification, ratings, location information, support, or other safety measures do not constitute a guarantee that a request is free of risk. 2Hands cannot identify every hazardous condition or predict every User's behavior.
78. Disputes With Customers
Disputes involving the underlying task are primarily between Helper and Customer. 2Hands may assist with Platform records, payments, communications, account decisions, or dispute review. Such involvement does not make 2Hands the employer, insurer, attorney, representative, or guarantor of Helper.
79. Governing Law
This Agreement is governed by the laws of the State of Utah, except where federal law or another mandatory law controls.
80. Venue
Subject to rights that cannot legally be waived, judicial proceedings involving 2Hands or FitaSol LLC arising from this Agreement shall be brought in an appropriate state or federal court located in Utah.
81. Electronic Agreement
Helper agrees that this Agreement may be accepted electronically. Checking an agreement box, pressing an acceptance button, electronically signing, or another affirmative electronic action may constitute acceptance. 2Hands may maintain electronic records documenting acceptance.
82. Versioning and Reacceptance
This Agreement may have a version number and effective date. 2Hands may retain records identifying Helper, version, acceptance date and time, acceptance event, and associated audit information. If 2Hands makes a material change, Helper may be required to affirmatively accept a newer version before accepting additional requests.
83. Changes to This Agreement
2Hands may modify this Agreement prospectively. Material changes may require renewed acceptance. Non-material administrative or clarification changes may not require renewed acceptance where legally permitted. Previous versions and acceptance records may be retained.
84. Relationship to Other Policies
This Agreement should be read together with the Terms of Service, Privacy Policy, Cancellation & Refund Policy, applicable SMS consent, applicable payment terms, and transaction-specific terms. If this Agreement contains a more specific provision governing Helper participation, it controls on that subject to the extent of an actual conflict with the general Terms.
85. Severability
If a provision is determined to be invalid or unenforceable, it will be enforced to the maximum extent permitted or severed as necessary. The remaining provisions continue in effect unless law requires otherwise.
86. No Waiver
Failure by 2Hands to enforce a provision on one occasion does not waive the right to enforce it later.
87. Assignment
Helper may not assign or transfer this Agreement or the Helper account without written authorization from 2Hands. 2Hands may assign this Agreement in connection with a merger, acquisition, financing, reorganization, sale, change of control, or transfer of the Platform, subject to law.
88. Entire Agreement Regarding Helper Participation
This Agreement, together with incorporated policies and applicable transaction-specific terms, constitutes the agreement governing Helper participation on the Platform. Oral statements by Customers or other Helpers cannot modify this Agreement on behalf of 2Hands.
89. Survival
Provisions concerning payments, taxes, Customer information, confidentiality, property damage, fraud, indemnification, limitation of liability, records, disputes, and other obligations that logically survive termination remain effective after Helper participation ends.
90. Contact
2Hands is operated by FitaSol LLC d/b/a 2Hands App, Utah, United States. Website: 2handsapp.com. Support: support@2handsapp.com.
91. Helper Acknowledgment
By affirmatively accepting this Agreement, Helper acknowledges that Helper had an opportunity to review it; understands that 2Hands operates a technology marketplace and does not itself perform underlying services; is free to decide whether to accept available requests subject to obligations after accepting; is responsible for determining whether Helper is capable and legally qualified to perform an accepted task; understands earnings are not guaranteed and tax obligations may be Helper's responsibility; is responsible for Helper's own acts and omissions; must protect Customer information; must comply with safety and conduct requirements; and agrees to be bound by this Agreement.
